These General Terms and Conditions (GTC) apply to all agency services provided by IST-HAAR to customers.
IST-HAAR provides agency services exclusively and does not itself act as a provider of medical, tourist, or other services.
IST-HAAR arranges contacts and services between customers and external service providers (e.g., clinics, hotels, transfer or airline companies).
The performance of the arranged services is the sole responsibility of the respective service providers.
IST-HAAR is not a tour operator within the meaning of the Package Travel Act (PRG).
– No treatment or travel contract is concluded between the customer and IST-HAAR.
– The customer’s contractual partners are exclusively the clinics, hotels, or other providers arranged.
The arrangement activities include in particular:
– Forwarding patient information and image material to the clinic,
– Organizing appointments at the clinic,
– Assistance with hotel bookings and airport transfers, if necessary.
The following are not included in the services provided by IST-HAAR:
– Medical consultation, diagnosis, or performance of medical procedures,
– The actual hair transplant and all ancillary medical services,
– The provision of hotel or transfer services,
– Flight bookings or visa issuance.
By transmitting patient data to IST-HAAR, the customer places an order for mediation.
The contract for the desired services is only concluded upon acceptance by the respective service provider (e.g., clinic, hotel).
Several mediated individual services do not constitute a uniform travel contract with IST-HAAR, even if they are booked in close succession.
– The customer does not make any payments to IST-HAAR.
– All costs are to be paid directly to the respective service providers (clinic, hotel, airline, etc.).
– IST-HAAR receives a commission exclusively from the clinic and not from the customer.
The customer can cancel a planned treatment at any time in writing or by email.
Any cancellation fees or costs incurred by the respective service providers shall be borne by the customer.
– IST-HAAR is solely liable for the proper mediation.
– Liability for the quality, performance, or success of the mediated services is excluded.
– In particular, IST-HAAR accepts no liability for:
– medical treatments and their results,
– treatment errors or complications,
– services provided by hotels, transfer services, or airlines,
– entry formalities, visas, flight delays, or travel documents.
– A guarantee of success with regard to medical treatment is expressly excluded.
The customer is responsible for complying with the applicable entry and exit requirements of Turkey, including visa and passport regulations.
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the applicable Turkish data protection laws (KVKK).
– Only data that is necessary for the placement will be collected.
– Health data will only be processed with express consent.
– Data will only be passed on to the service providers necessary for the fulfillment of the contract (clinic, hotel, etc.).
– The customer has the right to information, correction, deletion, restriction of processing, and objection in accordance with the GDPR at any time.
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes arising from or in connection with these General Terms and Conditions is Vienna, Austria.
